Amgen v. Regeneron and Sanofi: UPC Court of Appeal maintains Amgen’s patent

The UPC’s Court of Appeal has confirmed the validity of Amgen’s patent on the drug Repatha®. The decision aligns with the recent decision issued by the Opposition Division at the EPO, and provides guidance on the assessment of inventive step, added matter and sufficiency/enablement. It appears that the UPC and the EPO apply a harmonized approach leading to matching results.
